These AI Terms explain how AI works in KissMySkills and who is responsible for what. They form part of our Terms of Service and are consistent with section 7 of our Data Processing Addendum. If they conflict, the DPA prevails for personal data.
1. Two ways AI touches your data
(a) Your own AI assistant. Our connector (mcp.kissmyskills.com) lets an AI assistant you choose, such as Claude or ChatGPT, read and act on your KissMySkills workspace. You connect it, you approve its access through OAuth, and you can revoke that access at any time. Your assistant's provider processes what the assistant reads under your agreement with that provider, and its chat history follows that provider's rules. That provider is not our subprocessor. The CRM, Contracts and the connector make no AI model calls of their own.
(b) Our own AI features. Two features use AI models that we run on Cloudflare Workers AI, our hosting provider:
- Receptionist uses a small open model to rephrase the answers the site owner configured, and an embedding model to match visitor questions to those answers. For each reply it sends the model only the site name, up to three configured answers and the visitor's question (up to 500 characters), with e-mail addresses and phone numbers removed first. The site owner can switch AI rephrasing off per site; Receptionist then answers with the configured text only.
- Tools on kissmyskills.com (free and paid) process the text you submit to an AI tool.
No data from these features is sent to a third-party AI model provider.
2. No training
We do not use your data, your inputs or the outputs you get to train or fine-tune AI models, and we do not let our subprocessors do so.
3. Inputs and outputs
- What you or your users put into an AI feature ("Input") and what it returns ("Output") are your content. As between you and us, you own the Output, to the extent the law allows anyone to.
- Others may receive similar Output; that does not make it theirs or yours exclusively.
- We process Input and Output only to provide the feature, as described in the DPA.
4. Your responsibilities
- Check the Output. AI can be wrong, incomplete or out of date. Review Output before you rely on it, publish it or send it to anyone.
- Humans decide. Do not use AI features to make decisions with legal or similarly significant effects on people (for example hiring, credit, access to essential services) without meaningful human review.
- Transparency. The Receptionist chat widget labels itself as an AI assistant in its header. Do not remove or obscure that label, and do not suggest to visitors that they are talking to a human.
- Lawful Input. Only put in data you are allowed to process. Do not put children's personal data or special-category data (health, religion, etc.) into AI features unless you have a lawful basis and appropriate safeguards.
- Your AI client. You are responsible for the AI assistant you connect, the permissions you give it, and your agreement with its provider.
5. EU AI Act
You must not use the Services for any practice prohibited by Regulation (EU) 2024/1689 (the AI Act). The Services are not designed as a high-risk AI system; if you use them in a context the AI Act treats as high-risk, you are responsible for the obligations that apply to you as deployer, including human oversight.
6. Acceptable use
Do not use AI features to generate unlawful, deceptive, harassing or infringing content, to impersonate people, to pass AI Output off as written by a human where that would mislead, or to try to extract our systems' instructions or other customers' data.
7. No warranty on Output
AI features are provided as described in the Terms. We do not guarantee that Output is accurate, complete or fit for a particular purpose. This does not limit liability that cannot be limited by law.
8. Changes
If we add a third-party AI model provider for customer data, we will list it on our subprocessor page and give notice as described in the DPA before it starts.
