Protected health information (PHI) stays out unless your organization approved the tool
- Under HIPAA, a vendor that handles PHI for a covered entity needs a Business Associate Agreement (BAA). Consumer and individual AI plans are generally not covered. AI vendors offer BAAs only for specific business or enterprise setups. Ask your compliance team which tool, if any, is approved.
- De-identify before you paste. HIPAA's Safe Harbor method lists 18 identifiers to remove, including names, geographic detail smaller than a state, all date elements except year, phone numbers, email addresses, record numbers and full-face photos. "Patient A, 60s, HTN" is fine; a name and date of birth is not.
- Outside the US, GDPR, the UK GDPR and local health data rules apply. The same principle holds: no identifiable patient data without an approved tool and a legal basis.
- AI drafts, a clinician decides. Every note, letter and instruction must be reviewed by a qualified professional. Do not use AI for diagnosis, dosing or triage decisions.
